This Privacy Policy applies to all websites and mobile applications (each a “Site”) operated by Extreme Pizza. This Privacy Policy describes how we use, store, and disclose information that we obtain about you through our Sites, including information that we obtain through any promotional program or other service that we provide (in whole or in part) through any of our Sites, such as the Extreme Pizza online ordering platform and Extreme Rewards loyalty program.

Please read this information carefully before accessing any of our Sites. By accessing any of our Sites, you agree to the terms of this Privacy Policy.

Safeguarding your privacy and the security of your personal information is very important to Extreme Pizza. We ask that you take a few minutes to read the following policy so that you understand how we collect and treat your personal information. By using or navigating around the website or utilizing any of the services we provide here including our Mobile App, you acknowledge that you have read and understand and agree to be bound by this Privacy Statement. If you do not agree to be so bound, please do not remain on the Website. As we continue to improve and expand our services, this policy might change, so please check it periodically. We’d like to emphasize that Extreme Pizza has taken appropriate precautions to prevent unauthorized access or disclosure of your personal information, as well as measures to maintain data accuracy and ensure that the information is used only for the purposes described above.

You have the right to access and correct the information we collect about you.

Opt-Out

In order to provide service to you, we may send you communications related to your transactions, security or the administration of its website. From time to time, Extreme Pizza and its affiliates may also wish to send you other messages or updates about our website, Extreme Pizza, our affiliates, or their promotions and other activities. If you do not wish to receive non-transaction/security related communications from Extreme Pizza and its affiliates, please send an email containing your request via our Contact Us page.

Effective date of this policy

This Privacy Policy takes effect January 1, 2023. We must follow the privacy practices described in this Notice while it is in effect. This Privacy Policy will remain in effect until we change it. This Privacy Policy replaces any other information you have previously received from us with respect to privacy of your information.

Updates to this policy

Extreme Pizza reserves the right to change this Privacy Policy from time to time at its sole discretion and without sending notice to you, so you should review this Privacy Policy periodically.  The effective date of this notice and any revised or changed notice may be found on this page, on the upper left corner of the notice.  Any changes will be effective after the effective date of the change and will not affect any dispute arising prior to the effective date of the change.

Collection of Personal Information

We may collect the following information from users who provide us this information in order to create an account and/or order from Extreme Pizza or any of its independently owned and operated franchised restaurants or food service providers:  your name, your e- mail address, your phone number, your address, your credit card numbers, your birthday and your order history.  When you download our Application, we may collect your name, mailing address, and email address, and current location. We will request your permission prior to determining your current location, which we use for the purpose of identifying a restaurant nearest to you.

If you elect to establish an online account, we have contracted with a third party to perform these functions for us, so that third party’s privacy policy  http://revention.com/hungerrush/privacy-policy  and terms of use  http://revention.com/hungerrush/terms-of-use  also apply.

Extreme Pizza’s policy is to prohibit the unlawful disclosure of your personal information, but EXTREME PIZZA MAKES NO REPRESENTATION OR WARRANTIES REGARDING THE SECURITY OR PRIVACY OF INFORMATION THAT YOU MAY PROVIDE THROUGH THE SITES. 

Extreme Pizza reserves the right to share any information provided by you with our independently owned and operated franchised restaurants and/or food service providers.  Extreme Pizza may contact any individual who has shared personally identifiable information with Extreme Pizza for sales and marketing purposes, for feedback about Extreme Pizza and its services, or for any other reason logically related to the operation of Extreme Pizza business. 

We may supplement the information we collect about you with outside records from third parties in order to provide you with information, services, or goods you have requested, to enhance our ability to serve you, and to tailor our content to you. We may combine the information we receive from those other sources with information we collect. In those cases, we will apply this Privacy Policy to the combined information. 

Online Technology

The Sites’ technology has the ability to collect data other than personally identifiable information. Extreme Pizza may collect information about your computer configuration, such as your browser type, operating system, or ISP domain name. Extreme Pizza may collect information about the site you last visited prior to visiting a Site or about your activity during your visit to a Site. This information may be used by Extreme Pizza to administer the technical and operational aspects of a Site, and may include using your IP address to help diagnose problems with our server. Your IP address may also be used to gather broad demographic information for aggregate use. Extreme Pizza may use cookies (a piece of data stored on the user's hard drive containing information about the user) to assist in performing some or all of these activities. You can set your browser to accept all, some or no cookies. If you set your browser to reject all cookies, you may be limited in your ability to access some or all aspects of a Site or be required to re-enter information. 

Information that We Collect from Third Parties.

We may collect information about you, either individually or in the aggregate, from third party marketing companies.

Information that We Collect About You from Facebook.

You may log into our Site and Application through your Facebook account. We do not collect your Facebook log-in information. If you log in through Facebook, we will request that you grant us permission to (i) access and collect your Facebook basic information (this includes your name, profile picture, gender, networks, user IDs, list of friends, date of birth, email address, and any other information you have you have set to public on your Facebook account); (ii) send you email; (iii) post to your Wall; (iv) access posts in your news feed; and (v) access your Facebook data at any time even if you are not using Facebook. If you permit Extreme Pizza to have access to this information, then Extreme Pizza will have access to this information even if you have chosen not to make that information public.

For information about how Facebook may disclose your information, including any information you make public, please consult the Facebook Privacy Policy. We have no control over how Facebook uses or discloses the personal information you provide to it. We store the information that we receive from Facebook along with other information that we collect from you or receive about you. We may run contests through Facebook, and collect information from you, which may vary based on the particular contest. Information We Collect Automatically.

We may use cookies, web beacons, and other automated devices to collect information about you when you use our Services. Please see the section below for a description of this collection and our use of this information.

Mobile Devices

Extreme Pizza technology may also collect the unique identifier (“Device Identifier”) for any computer, mobile phone, tablet or other device (any of which are referred to herein as a “Device”) used to access a Site or through use of the Extreme Pizza mobile app. A Device Identifier is a number that is automatically assigned to your Device, and our servers identify your Device by its Device Identifier. Some mobile service providers may also provide us or our third party service providers with information regarding the physical location of the Device used to access a Site or through use of the Extreme Pizza mobile app.

Personally Identifiable Information

The preceding paragraphs describe the categories of personally identifiable information that Extreme Pizza collects in the Sites.  Extreme Pizza may disclose personally identifiable information you provide to third parties if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:  (a) complete the sales transaction, such as providing your payment or delivery information; (b) comply with legal process; (c) enforce the Terms of Use; (d) respond to claims that any information you provide violates the rights of third parties; (e) protect the rights, property, or personal safety of Extreme Pizza, its users and/or the public; or (f) in relation to the sale, assignment, transfer or acquisition of all or substantially all of Extreme Pizza assets or shares by a third party.  Except as provided in the preceding sentence, Extreme Pizza will NOT sell or trade your personally identifiable information with third parties, such as sellers of goods or services.

Contests, Sweepstakes, and Other Promotions.

We may collect information about you when you participate in a promotion that we sponsor, such as a contest or sweepstakes (which we may sponsor alone or co-sponsor with one or more third parties). To participate in one of our promotions, you may be asked to provide your name and your email address, mailing address and/or other contact information. For some promotions, we may request other information about you as well. Note that your participation will be subject to the official rules of the promotion (as well as this privacy policy and the privacy policy of any co-sponsor).

Careers 

If you choose to explore career opportunities at Extreme Pizza by providing information on our “Careers” webpage, you will be asked for contact information as well as information about your employment and educational history and other relevant information. This portion of our Site may be operated by a third-party service provider collecting the information on our behalf.

Third-Party Integrated Services

We may incorporate third-party ads and other third-party content on our Sites, and integrate other third-party offerings into our Sites, enabling certain third parties to collect information about you or your online activities across other websites and over time through your use of our Sites. Any information collected through such integrated technologies is collected directly by these third parties for use by such third parties and other authorized parties, subject to the privacy policies of those other parties.

Tracking

Extreme Pizza will not recognize Web browser “do not track” signals.  If you would like additional information about online tracking and various opt-out mechanisms, please see  http://donottrack.us/ Because Extreme Pizza links to social media sites, and from time to time may include third-party advertisements, other parties may collect your personally identifiable information about your online activities over time and across different web sites when you visit a Site. Please note that not all tracking will stop even if you delete cookies. 

Cookies and Other Tracking Mechanisms

We use and our third party service provide use cookies or other tracking mechanisms to track information about your use of our Services, including: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; your interaction with the Application; length of time you visit our Site and Application; and the referring URL, or the webpage that led you to our Site. We also may collect the following information about your use of the Application: Apple device ID; location and language information; device name and model; operating system type, name, and version; your interaction with the Application; and the length of time that you are logged into our Application.

We may use the information gathered through these methods in anonymous or aggregated form to analyze ways to improve our Site or Services. This information may also be associated with your email address and may be combined with other information, including personally identifiable information that we collect about you.

Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies).

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Application, while other cookies are used to enable a faster log-in process or to allow us to track your activities at our Site and Application.

There are two types of cookies: session-based and persistent-based cookies. 

Session Cookies. Session cookies exist only during an online session. They disappear from your computer when you close your browser or turn off your computer. We use session cookies to allow our systems to uniquely identify you during a session or while you are logged into the Site. This allows us to process your online transactions and requests and verify your identity, after you have logged in, as you move through our Site.
Persistent cookies. Persistent cookies remain on your computer after you have closed your browser or turned off your computer. We use persistent cookies to track aggregate and statistical information about user activity, which may be combined with other user information.
Third Party Cookies. We may also engage third parties to track and analyze non- personally and personally identifiable Site data. We use the data collected by such third parties to help us administer and improve the quality of the Site and to analyze Site usage. Such third parties may combine the information that we provide about you with other information that they have collected. This Policy does not cover such third parties’ use of the data.

Disabling Cookies

Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Site who disable their web browsers’ ability to accept cookies will be able to browse the Site; however, some Site and Application features may not function if you disable cookies. Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We and our third party service providers also use clear GIFs in HTML e-mails to our customers, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Site Analytics

We may use automated devices and applications, such as Google Analytics, to evaluate usage of our Site and, to the extent permitted, our Application. We also may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

Encryption 

Extreme Pizza uses no encryption (data scrambling) on the Sites. When you are on any website that asks you for confidential information, you should check to see if the information being transmitted is encrypted in order to increase the security of your information.  Keep in mind that there is no such thing as perfect security. 

User Generated Content

Users may from time to time be permitted to submit their own content to our Site and Application, including, without limitation, reviews, comments and other text. We are not responsible for the privacy of any information that you choose to submit through this Site, the Application, our Services or through any social media site, or for the accuracy of any information contained in those postings. Any information that you disclose becomes public information. We cannot prevent such information from being used in a manner that may violate this Policy, the law, or your personal privacy.

Third-Party-Links

Our Site and Application contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but, instead, is governed by the privacy policies of those third-party websites, and we are not responsible for the information practices of such third-party websites. Note: the online ordering system is operated by Hungerrush.com and information collected by Hungerrush.com through that system is also subject to the Privacy Policy and User Agreement posted on the online ordering page. We have no responsibility for the information practices of Hungerrush.com.

How Secure Is Information About Me?

We have implemented commercially reasonable precautions, including, where appropriate, password protection, encryption, and SSL to protect our Site and the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security all of the time.

Can I Access and Modify My Personal Information?

You may modify any personal information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified or deleted may remain viewable in cached and archived pages of the Site or Application for a period of time. If you would like to access or modify your Facebook profile information, or adjust the types of information we receive from Facebook, you must adjust your Facebook account settings directly through Facebook. We have no control over how Facebook shares your information with us or other third parties. The information you provide to Facebook is subject to the Facebook Privacy Policy.

What Choices Do I Have?

We may send periodic promotional or informational emails to you. You may opt-out of such communications by following the opt-out instructions contained in the e-mail. Please note that it may take up to 10 days for us to process opt-out requests. If you opt- out of receiving emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any Services you have requested or received from us. As noted above, to adjust the types of information about you that we receive from Facebook, you must change your Facebook account settings directly through Facebook.

Children's Online Privacy Protection Act ("COPPA")

We make no active effort to collect personal information from children under the age of 13 and do not wish to receive any such information. If we learn that any unauthorized personal information of a child has been collected, we will take appropriate steps to delete such information. If you are a parent or guardian and discover that your child has provided any such personal information to us, then you may contact us at the email or mailing address noted at the end of this Privacy Policy below and request that we delete that information from our systems.

Terms of Use

Your use of our Site or Services, as well as any dispute over privacy, is subject to this Policy and our Terms of Use, available at http://www.ExtremePizza.com/terms-of-use, including applicable limitations on damages and the resolution of disputes.

Governing Law

By choosing to visit any of our Sites, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of California, without reference to the choice of law or conflicts of law principles thereof, and will be subject to the dispute resolution clause contained in the terms of use applicable to the particular Site. You also agree to abide by any limitation on damages contained in the terms of use applicable to the Site or any other agreement that we have with you.

Changes to this Policy

This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to our Privacy Policy on our Site, at http://www.Extremepizza.com/privacy-policy. If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our Site.

If you want to of being contacted by Extreme Pizza after you have shared your information, or you wish to correct the information you have provided, you may do so in one of three (3) ways:

 Follow the opt-out instructions at the bottom of any marketing e-mail from Extreme Pizza.

Extreme Pizza may link to other websites created and maintained by other public and/or private organizations. Extreme Pizza provides links to these sites as a service to our users. The presence of a link does not constitute Extreme Pizza endorsement of such site.  When users follow a link to an outside website, they are leaving Extreme Pizza and are subject to the policies of the owners/sponsors of the outside website(s). Extreme Pizza is not responsible for the information collection practices of non-Extreme Pizza sites.
